Welcome to Tolly. These Terms and Conditions of Service ("Terms") govern your use of the Tolly website and services (collectively, the "Service"). By using Tolly, you agree to these Terms. If you disagree with any part of the terms, you may not use our Service.

2. Description of Service

Tolly provides AI-powered interactive exercises, personalized feedback, and video analysis to help improve communication skills in areas such as sales, leadership, presentation, and public speaking. Our services are powered by Google's Gemini AI technology.

3. User Accounts

To use Tolly, you may need to create an account. You are responsible for maintaining the confidentiality of your account and password. You agree to accept responsibility for all activities that occur under your account.

4. Subscriptions and Payments

1. We offer subscription-based access to our services, processed through Stripe.
2. Free trials are available: 14 days for yearly subscriptions and 7 days for monthly subscriptions. Free trials are limited to one per user and account.
3. You may cancel your subscription at any time, at least 2 days before the renewal date.
4. Refunds are offered in accordance with European Union guidelines, within 14 days from the date of purchase.

5. User Data and Privacy

We do not store or have direct access to user's information from exercises such as answers, videos, or voice recordings. We only store results and scores. For more information on how we handle your data, please refer to our Privacy Policy.

6. Intellectual Property

Tolly does not claim ownership of user-generated content. We are not responsible for how data is used by our service providers (Google, Stripe). All content provided by Tolly, including but not limited to text, graphics, logos, and software, is the property of Tolly or its content suppliers and is protected by international copyright laws.

7. Disclaimer of Warranties

The Service is provided "as is" and "as available" without any warranties of any kind. While we strive for accuracy, AI-generated content and feedback may be incorrect. We do not guarantee the accuracy, completeness, or usefulness of any content provided through the Service.

8. Limitation of Liability

Tolly shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use or inability to use the Service.

9. Termination

You may terminate your account at any time by contacting us through the provided help email. We will authenticate your request and proceed with account deletion, removing all associated data. We reserve the right to terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of Poland, without regard to its conflict of law provisions.

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect.
